A top national law firm has an exciting opportunity for qualified lawyers with experience working in Planning law. As one of the most highly praised legal employers in the Yorkshire & North East region, candidates who can evidence at least 2+ years of post-qualification experience working in a strong real estate planning team can expect to join a highly profitable practice with a market leading approach when it comes to professional development and a supportive culture which is second to none.Candidates applying for this role must be qualified lawyers (either qualified as a Solicitor or through CILEx as a Chartered Legal Executive) as this role is not appropriate for anyone who works at levels below qualification.The successful candidate will be expected to undertake the following key responsibilities (this list is not exhaustive and will be reviewed periodically subject to developments):

  • Drafting, reviewing and negotiating s106 Agreements for housebuilders, registered providers, landowners and local authorities and liaising with clients regarding the same;
  • Advising upon legal planning issues including interpretation of planning consents; interpretation of planning conditions; issues around whether a planning permission has been lawfully implemented; the different types of planning permission and their interaction;
  • Advising upon the CIL Regulations and their application and advice around structuring a planning proposal to take account of the implications of CIL;
  • Giving advice associated with compulsory acquisition and Development Consent Order work whether for a promoting authority/agency or whether objecting to a proposed scheme;
  • Instructing and liaising with counsel on a number of projects, whether for written advice or as part of a larger scheme progressing to inquiry or court proceedings;
  • Advising on certificates of lawfulness and planning enforcement from the initial stages through to inquiry and/or judicial challenge as appropriate;
  • Working on judicial review advice and court proceedings, whether making an application or advising in respect of a challenge in the courts;
  • Offering regular advice upon highways issues including in particular public rights of way including stopping up / diversion applications, strategic advice for dealing with public rights of way / desire lines, landowner statements;
  • Contributing to the business development initiatives of the team, whether presenting seminars, writing articles or networking in the regions;
  • Advising in relation to potential enforcement issues, defending or prosecuting current enforcement proceedings;
  • Attending planning committee to advise members and officers of client local planning authorities (PQE dependent); and
  • Carrying out basic planning due diligence to support wider real estate and housing departments.
