Head of Department – Financial Mis-Selling (Business Energy & Undisclosed Mortgage Commission Litigation)
Location: Manchester or London office
Experience: 6+ years PQE (civil litigation with relevant financial mis-selling experience)
About the Role
We are seeking a highly experienced, qualified litigator (solicitor or legal executive) to launch and lead a new department focusing on:
* Business Energy mis-selling: cases involving secret or undisclosed commissions paid by energy suppliers to brokers, inflating client costs.
* Mortgage commission mis-selling: claims based on undisclosed commissions between brokers and lenders (e.g. similar to Plevin-style cases).
You will be instrumental in establishing the strategic, operational, and compliance frameworks of this specialist department, while directly supervising and progressing complex litigation.
Key Responsibilities
* Build and lead a new legal department focused on Business Energy and mortgage commission mis-selling litigation.
* Develop and oversee case strategy and litigation plans, including pre-action protocol, discovery, expert evidence, and settlement negotiations.
* Lead high-value civil claims involving financial institutions, brokers, and utilities suppliers, particularly group or multi-claimant cases.
* Supervise junior lawyers and paralegals, providing training, mentoring, and legal guidance.
* Work with internal teams to ensure robust client onboarding, risk management, and procedural compliance.
* Liaise with counsel, external experts, funders, and regulatory bodies where necessary.
* Help shape legal content, precedents, and template letters to ensure consistent and efficient case progression.
* Maintain up-to-date knowledge of developments in financial litigation, consumer protection law, and relevant FCA/SRA case law.
Candidate Profile
* Qualified Solicitor or FCILEX with 6+ years post-qualified experience in civil/commercial litigation.
* Strong background in financial mis-selling or consumer credit litigation – ideally with direct experience handling:
o Claims involving undisclosed commissions (mortgages, energy contracts, loans).
o Cases arising from irresponsible lending, secret commissions, or broker-facilitated mis-selling.
* Proven success in litigating complex or high-volume claims, particularly where group litigation or financial regulation is involved.
* Commercially astute with the ability to identify high-impact legal strategies and outcomes.
* Exceptional drafting, negotiation, and client communication skills.
* Comfortable managing teams and contributing to business growth through legal leadership.
Desirable (but not essential)
* Experience with Plevin-style litigation, CCA breaches, or energy broker mis-selling.
* Exposure to managing third-party litigation funding, ATE insurance, or cost budgeting in civil claims.
* Familiarity with technology-assisted legal workflows (e.g. automated onboarding, CRM-based case tracking).
