TOWING ORDINANCE SPECIAL MAGISTRATE - Florida Association of Counties : Job Details

The intent and purpose of Chapter II, Article IX, of the Leon County Code of Laws is to promote, protect, and improve the health, safety, and welfare of the citizens of Leon County contracting for special magistrate services. The person in this role will have the authority to impose administrative fines and other noncriminal penalties to provide an equitable, expeditious, effective, and inexpensive method of enforcing the provisions of Chapter II, Article IX, of the Leon County Code of Laws. See Leon County Ordinance No. 25-05.

Accordingly, Leon County will be contracting with a qualified attorney to provide special magistrate services. This is not an employment position.

The special magistrate shall have the power to:

• Adopt rules for the conduct of the hearings held pursuant to section 11-333.
• Subpoena alleged violators and witnesses to hearings. Subpoenas may be served by the county sheriff.
• Take testimony under oath.
• Issue orders following a hearing, which orders shall have the force of law and shall set forth the steps necessary to be accomplished in order to bring a violation into compliance with the code that has been violated.
• Assess administrative fines and impose liens on real and personal property pursuant to chapters 162 and 125, Florida Statute (2024), or as those chapters may hereafter be amended.

The special magistrate shall be a member of the Florida Bar in good standing with a minimum of five years' experience as an attorney.
